A. Right of Withdrawal<\/h2>\n\n

Introduction<\/h3>\n\n

Consumers are entitled to a right of withdrawal in accordance with the following provisions, whereby a consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither attributable to their commercial nor their independent professional activity:<\/p>\n\n

Right of Withdrawal<\/h3>\n\n

You have the right to withdraw from this contract within fourteen days without giving any reason.<\/p>\n\n

The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the last goods.<\/p>\n\n

To exercise your right of withdrawal, you must inform us (Swit UG (haftungsbeschr\u00e4nkt), Kufsteiner Stra\u00dfe 69, 83026 Rosenheim, Germany, Tel.: +49(0)8035 963 95 60, Email: info@switplus.com<\/a>) by means of a clear statement (e.g., a letter sent by post or email) of your decision to withdraw from this contract. You may use the attached model withdrawal form, but it is not mandatory.<\/p>\n\n

To meet the withdrawal deadline, it is sufficient that you send the notification of the exercise of the right of withdrawal before the withdrawal period has expired.<\/p>\n\n

Consequences of Withdrawal<\/h3>\n\n

If you withdraw from this contract, we shall refund all payments we have received from you, including delivery costs (except for additional costs arising from the fact that you have chosen a type of delivery other than the most cost-effective standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we receive the notification of your withdrawal from this contract. For this refund, we will use the same payment method that you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees for this refund. We may withhold the refund until we have received the goods back or until you have provided evidence that you have returned the goods, whichever is earlier.<\/p>\n\n

You must return or hand over the goods to us without undue delay and in any case no later than fourteen days from the day on which you notify us of the withdrawal from this contract. The deadline is met if you send the goods before the period of fourteen days has expired.<\/p>\n\n

You bear the direct costs of returning the goods.<\/p>\n\n

You are only liable for any diminished value of the goods if this loss in value is due to handling that was not necessary to examine the nature, characteristics, and functionality of the goods.<\/p>\n\n

Exclusion or Premature Expiration of the Right of Withdrawal<\/h3>\n\n

The right of withdrawal does not apply to contracts for the supply of goods that are not prefabricated and for the manufacture of which an individual choice or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer.<\/p>\n\n

The right of withdrawal does not apply to consumers who, at the time of concluding the contract, do not belong to a member state of the European Union and whose sole residence and delivery address at the time of concluding the contract are outside the European Union.<\/p>\n\n

Associated\/Financed Transactions<\/h3>\n\n

If you finance this contract through a loan and subsequently withdraw from it, you are no longer bound by the loan agreement, provided that both contracts form an economic unit. This is particularly the case if we are also your lender or if your lender makes use of our cooperation regarding the financing. If the loan has already been disbursed to us when the withdrawal takes effect or when the goods are returned, your lender shall assume our rights and obligations under the financed contract in relation to you with regard to the legal consequences of the withdrawal or the return. This does not apply if the present contract concerns the acquisition of financial instruments (e.g., securities, foreign exchange, or derivatives). If you want to avoid a contractual obligation as far as possible, make use of your right of withdrawal and also withdraw from the loan agreement if you have a right of withdrawal for it as well.<\/p>\n\n
